‘Subject To’ Contracts Allow Buyers To Take Over Mortgage Payments

Subject to is a realty contract used when buyers take over another person’s mortgage payments. This strategy can be a good option for credit-challenged buyers who do not qualify for bank financing due to insufficient credit scores or lack of down payment funds.

With Subject to contracts property rights are transferred to the buyer, but ‘subject to’ compliance of contract terms. Ownership rights revert back to the property owner if buyers default on contract terms. When default occurs the buyer forfeits all funds vested into the property.

These contracts can provide benefits to all parties involved as long as agreements are properly executed and recorded. It is recommended to obtain legal counsel to ensure contracts are legal and transfer of property is in accordance with state laws.

Subject-to can be a good alternative when borrowers cannot afford a down payment. Bad credit buyers find this type of contract appealing because it provides them time to engage in credit repair strategies to boost credit scores.

Once the contract is executed buyers take over loan payments, but the loan contract remains in the original homeowner’s name. Once buyers are capable of qualifying for a mortgage they refinance the loan into their own name.

Property owners should conduct due diligence to ensure buyers possess the financial means to pay future loan installments. Buyers should conduct due diligence to ensure property owners are current with loan payments and property taxes.

Buyers should also research public records to determine if liens or judgments are attached to the property which could interfere with transfer once they obtain bank financing.

Homeowners sometimes engage in Subject to agreements if they have been unsuccessful in locating a qualified buyer willing to pay their asking price. Others use this contract when they can no longer afford loan payments and attempting to avoid foreclosure.

If homeowners can locate a buyer who is willing to take over payments and cure mortgage arrears they can stop foreclosure from occurring and minimize impact to their credit.

Real estate investors sometimes engage in Subject to contracts to sell investment properties to credit-challenged buyers. Doing so can provide debt relief to investors through assignment of property rights and grant buyers the opportunity to buy real estate even when they cannot qualify for a bank loan.

Subject to agreements is a legally-binding contract that is enforceable in a court of law. Property owners are required to record the document through district courts in the county where the property is located.

Subject to agreements are normally in place for 1 to 3 years to provide buyers ample time to establish or restore sufficient credit scores. Buyers are required to obtain bank financing when the contract reaches maturity date.

Buyers are responsible for costs associated with obtaining a mortgage note. Expenses typically range between 4- and 6-percent of the purchase price. Fees include loan application, loan origination, loan points, property appraisals and inspections, mortgage insurance, legal review fees, and various closing costs.

Buyers should strive to obtain bank financing as quickly as possible. A credit score of 720 or higher is needed to obtain the lowest interest rate. Most banks require borrowers to possess a credit score of at least 640 before they will approve financing.

Buffalo, New York —A proposed hotel that was supposed to be built at the corner of Elmwood and Forest Avenues in Buffalo, New York is apparently off the table. The former proposal was going to be called The Elmwood Village Hotel and would have consisted of 72 rooms and cost between $7 to $10 million American dollars to build.

Today several unknown individuals were seen removing a sign that was dedicated to the “Elmwood Village Gateway,” which signifies the beginning of the Elmwood Village at the formerly proposed project’s location.

Nearly an hour later the men replaced the sign with a different and unexpected sign: “For Sale: 5 commercial parcels and 1 carriage house, By: Owner.” Those 5 “parcels” are 1109-1121 Elmwood and 999 Forest Avenue, which is located in an illegal alley, according to the City of Buffalo, behind the 5 other properties on Elmwood. Hans Mobius owns all properties named in the sale.

Sam Savarino, CEO of Savarino Companies never owned the properties and has repeatadly told Wikinews in exclusive interviews that he still had a “contract to buy the properties” and on October 2, 2006 told Wikinews in an exclusive interview that he “extended” the “agreement to purchase the property[s] and will have it under contract for what we hope is a sufficient period of time.”

“He [Mobius] is undoubtedly concerned because he has lost some tenants and is a bit impatient. I think he has properly portrayed the situation,” said Savarino in an exclusive interview with Wikinews.

Savarino also says that there may be “legal issues” to work out now, before anything else can move forward, regarding the proposal.

“There are some legal complexities that must be sorted out before anything can happen there,” added Savarino.

The welcome sign was; however, not removed entirely. The sign was placed, facing the same direction of north, on the side of the Forest Plaza Art Gallery, a new art gallery located on the corner of Forest and Elmwood.

Nancy Pollina, owner of Don Apparel which was located at 1109 Elmwood, but closed on October 14, 2006 considers this a possible “victory” in regards to the lawsuit filed against the hotel to stop it from being built, alleging that several laws were broken, including not performing an Environmental Impact Study before the proposal was approved by the city, during its approval and the proposal was “rushed.” Patricia Morris, who operates Don Apparel with Pollina, Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway, were also plaintiffs in the lawsuit. They filed the suit with a lawyer representing them, Arthur J. Giacalone, on April 25, 2006 in New York State Supreme Court, but the case has never gone to a courtroom.

Giacalone believes that a press release issued in July regarding the project was nothing but a statement to “save face,” but that the placement of the for sale sign might be a way of convincing Savarino to speed up the sale of the properties.

“I thought all along that Savarino’s July press release might be no more than an effort to save face. But we have no way of knowing. Similarly, Mobius might have put the for-sale sign up in an attempt to pressure Savarino into closing the deal. There’s no way to tell,” said Giacalone in an exclusive interview with Wikinews.

In regards to the lawsuit, Giacalone thinks it may now be in “limbo.”

“The lawsuit still sits in limbo,” added Giacalone.

Woman returns home with Christmas turkey, a month after setting out

A Scottish woman who set out before Christmas to purchase a turkey finally made it home on Monday, after being cut off by snow for a month. Kay Ure left the Lighthouse Keeper’s cottage on Cape Wrath, at the very northwest tip of Great Britain, in December. She was heading to Inverness on a shopping trip.

However on her return journey heavy snow and ice prevented her husband, John, from travelling the last 11 miles to pick her up. She was forced to wait a month in a friend’s caravan, before the weather improved and the couple could finally be reunited.

They were separated not just for Christmas and New Year, but also for Mr Ure’s 58th birthday. With no fresh supplies, he was reduced to celebrating with a tin of baked beans. He also ran out of coal, and had to feed the couple’s six springer spaniels on emergency army rations.

“It’s the first time we’ve been separated”, said Mr Ure in December. “We’ve been snowed in here for three weeks before, so we are well used to it and it’s quite nice to get a bit of peace and quiet.”

Increasing House Value By Installing Laminate Flooring}

Working my way through college, I found it easier to do odd jobs that required manual dexterity rather than sitting an office since most of my days were spent sitting down, listening to lectures, doing assignments and the like. I felt that my muscles needed the exercise and the pay for manual labor was good and had a flexible time. A friend of mine had a construction and home development company and offered me a part time gig installing laminate flooring. At that time, laminate flooring was new technology, something different and interesting to do.

As compared to installing hardwood flooring, it was much easier and simpler and the net effect and look was likewise comparable to hardwood flooring itself, though this will always be debated by hardwood purists. Installing laminate flooring was even relatively easier on my part since the houses that I was to work on were new ones, those recently built by my friend and his company so in essence, all I had to do was go to the room designated, get the square footage, add around 5% to the area, and then get the materials and work on it. I would work on an almost completed room which was almost done save for the installation of the electrical outlets and the base boards.

Most of the time, I would choose to work on odd hours like lunchtime or on weekends and Sundays when nobody was there. Installing laminate flooring on a whole house could take a day or so. It wasnt hard to do but the trick there was getting the right measurements and maximizing the cut of the laminated flooring. Since I was essentially given a full roll of laminate flooring, I would find the best way to cut the pieces to get a lower percentage of wastage. To me it was like solving a non verbal puzzle, akin to those pieces of plastic strips which could be made into different shapes, some toy which was popular at the start of the 80s decade whose name I fail to recall. A lot of the time spent was actually not in the installation but in the preparation process.

Though I had the measurements since most of the units were the same, it was the cutting of the laminate flooring that took most of the time initially. Then once I had a couple of houses done, I decided to precut most of the pieces and then just label and number them for quick reference. Every Sunday, I would start around 9 am doing the second floor first. It was a lot of squatting, kneeling and bending work so I would take a five minute break every hour and a half. After a while, I just wanted to finish the work on a per house basis and then take my break after a house was done. It wasnt as easy as I thought. Still it felt nice to see the product of your work.

One time I got to view one of the houses I had done as it became a model house and showroom of sorts. The blend of the right furniture and finishing details and interiors made the house more than tempting to purchase. Installing laminate flooring did its part to make the house more livable.

Satire site Uncyclopedia, a parody of online encyclopedia Wikipedia, has been labeled by the Malaysian government as dangerous. The Internal Security Department of Malaysia issued the warning today, saying that the site has “messages and information insulting Malaysia”.

The warning notes the creation date of the website as being 5 January 2005, and hosted by Wikia, Inc., both of which are correct. However, it claims Wikia owns Wikipedia; Wikipedia is a charitable non-profit website owned by the non-profit Wikimedia Foundation, while Wikia is an independent, for-profit company.

The report evidently mentions that Uncyclopedia covers Malaysian “history, culture, the political leaders, the government, the national song and the name / history of the national flag,” none of which is “correct”. They accuse the website of helping to reinforce a bad international image of their country.

There are no reports of the site being blocked from access within the country, only this statement, which urges Malaysians not to circulate the content.

Uncyclopedia’s article on Malaysia begins:

The site has fired back with a parody article posted at the site under their UnNews section, titled Uncyclopedia Internal Security Department warns on Malaysia. The article suggests that the “Internal Security Department of the Uncyclomedia Foundation,” which is a facetious and fictitious parent organization of Uncyclopedia, identifies Malaysia “as a dangerous country… It warned its people not to use the country today.”

There are forty-seven individual language editions of Uncyclopedia, including Tolololpedia, which is written in Bahasa Melayu, the Malay language. This is in addition to fictional “language” editions which include Oscar Wilde, Newspeak, N00b, White Supremacist, and Re: PharmaccgRy.

US considers taxing earnings from online games

With online gaming in persistent worlds becoming more prevalent, a US congressional committee has begun to look into the tax implications of these booming online economies. Games such as World of Warcraft and Second Life have large player driven economic systems in which – either following the rules or against them – real world currencies are exchanged for in-game currencies. With the GDP of some of these economies rivaling that of some small countries, the US government is wondering if it is missing out on a potential source of tax revenue: or as some gamers might put it, the IRS is asking “You buy gold?”.

In cases where exchange of a real world currency for in-game currency is permitted by the rules of the game, some of these online games such as Second Life require that players report any income generated by these means to his or her government. In most on-line games however, a black market exists where players buy and sell in-game currencies in direct violation of the game’s rules; situations involving black markets are notoriously hard to tax.

Compounding the issue of currency exchange is the existence of in-game assets. In the real world if someone wins a luxury vehicle, he or she is expected to pay a capital gains tax on his or her winnings. If a 40 person “raid” in World of Warcraft gets a rare “drop,” worth up to thousands of dollars if sold illegally, should they be required to pay a capital gains tax?

Even if the issue of capital gains is ignored, there is still the matter of sales tax. In many of these games, non-player characters and players alike sell items to one another. If sales tax is to be applied, at what rate should it be charged and to what State does it go? Questions such as these have just recently been answered in much less hazy situations such as online versions of brick and mortar establishments.

Dan Miller, senior economist for the Joint Economic Committee had this to say on the issue, “I found that talking about this issue with some of the other economists on the committee, they are not really familiar with what a virtual economy is. The idea of Second Life or World of Warcraft or some of these other synthetic universes, they have trouble wrapping their head around it. So there’s an educational hurdle to overcome here.”

The preliminary findings of the committee state that virtual economies deserve clarification of existing tax laws, not new taxes.

India: Maharashtra plastic ban comes into force

On Saturday, the plastic ban in the Indian state of Maharashtra came into force. In an attempt to minimise pollution, the state government has introduced a ban on single-use plastics.

The leader of the Yuya Sena political party, Aaditya Thackeray, said on Twitter, “The ban on single use disposable plastic cups, plastic bags, plastic straws, plastic plates and cutlery, styrofoam cutlery and non woven bags”. He added, “these are global issues now and we have taken a step to combat it”.

Plastic pollution has led to the choking of drains, marine pollution and a risk of animals consuming plastics. This year, India’s motto for World Environment Day — June 5 — was “Beat Plastic Pollution”. People violating the plastic ban are to face a fine of 5,000 Indian Rupees (INR) for the first offence. For the second offence, the fine is INR 10,000 and the third time offence is INR 25,000 and a three-month prison term. Deputy municipal commissioner Nidhi Choudhary said, “To weed out corruption, we plan to give inspectors payment gadgets for electronic receipts of the fines”.

The Maharashtra government has given a 90-day period for manufacturers to dispose of existing polyethylene terephthalate (PET/PETE) plastic spoons and plates, while shopkeepers and citizens in general have six months to dispose of plastics. However, the ban does not prohibit plastic usage for wrapping medicines or milk cartons thicker than 50 microns.

The state government had announced the decision for the plastic ban on March 23. According to NDTV’s report, Maharashtra is the eighteenth Indian state to enforce a state-wide plastic ban. Aaditya Thackeray also said, “I congratulate the citizens for making this into a movement, even before the ban was enforceable, giving up single use disposable plastic.”

In today’s economy, those living on their own for the first time will find living alone a daunting task. Prices are too high for one person to pay, and they seem to only be getting higher. Thankfully, most apartments allow two or more people to group up as roommates, to share the load. But is this a good idea in the grand scheme of things? Having a roommate ensures an extra level of security for the nervous first-timer, who would rather not have to deal with the feeling of paranoia a new apartment can cause in the middle of the night.

Roommates are, despite the occasional horror story, a boon to people moving into their own place for the first time. They handle half the rent, provide an extra level of security, and give you someone to interact with, so you don’t feel as alone as you would otherwise.
