Buffalo, New York —The Common Council of Buffalo voted on Tuesday to send the Elmwood Village Hotel proposal “to committee for further discussion”, after citing the need for more public involvement.

The Elmwood Village Hotel is a development proposal by the Savarino Construction Services Corporation, a project designed by the architect Karl Frizlen of The Frizlen Group. The hotel would be placed on the southeast corner of Elmwood and Forest Avenues in Buffalo.

To make way for the project, at least five buildings located at 1109 to 1121 Elmwood Ave would be demolished. At least two properties on Forest Avenue could also be demolished. The Elmwood properties, according to Eva Hassett, Vice President of Savarion Construction, are “under contract”, but it is unclear if Savarino Construction actually owns the Elmwood properties. Hans Mobius, a former mayorial candidate, is still believed to be the current owner the properties. Mobius also owns 607 Forest Avenue.

The properties 605 and 607 Forest Avenue could also be included in the proposal according to Hassett.

“We would use a Special Development Plan to rezone 1119-1121 Elmwood and 605 Forest to a C-2 zoning category,” stated Hassett. It is possible that Savarino Construction may try to obtain a variance for 605 Forest, which would allow them to enforce eminent domain, should the hotel be allowed to go forward.

The building at 607 Forest was also discussed to be rezoned, but it is unclear what the plans would be for that property. During the February 28 Common Council meeting, Hassett stated that the properties 605 and 607 were “now off the agenda”.

Pano Georgiadis, owner of Pano’s Restaurant at 1081 Elmwood, owns the property at 605 Forest and attended Tuesday’s Common Council meeting.

“Having a hotel is a bright idea. We all love the idea of a hotel, but the way that it is presented, is wishful thinking. This hotel does not fit. It’s like putting two gallons of water in a gallon jug, it does not fit. At the last meeting, the architect admitted that they are planning to put the undergound parking lot and the hotel, right at the property line. If I open my window, I will be able to touch the wall, that goes fifty feet high”, said Georgiadis.

“There is a problem having a seventy-two room hotel and fifty-five parking spaces. That means that all the other cars will spill all over the neighborhood. The footprint is simply too small. If you have a bigger [parking] lot, and a smaller hotel, I will welcome a hotel. I have a parking lot at my own business, and I am chasing people all day long. Remember, the city says it has ‘zero tolerance [for illegal parking]’. Try telling that to the guy from Albany who came to see his kids, that are going to Buffalo State, who would get tickets totaling over a hundred dollars”, added Georgiadis.

The city’s Planning Board is scheduled to meet on March 14, 2006 at 9:00 a.m. about the proposal. Although a discussion will take place, no vote is expected to be taken.

At the moment, none of the properties are zoned for a hotel. Savarino Construction plans on asking for a C2 zoning permit. If that does not work, they plan to implement a new zoning plan called a “special development plan” which would allow for only a hotel on the site. That zone would not be able to be changed.

“This [project] justifies Mobius’s refusal to invest in any maitenance^[sic] or improvements”, on the properties said Clarence Carnahan, a local resident. “Where were the Council persons over the years? Where were the city inspectors over the years, to make sure that he maintained and improved his properties? The government was supposed to be protecting, not being preditorial. I see a predatorial issue here when it comes to this hotel. Over the years: Why has the local government been disfunctional when it came to Mobius’s properties? Refusal to invest in improvements, doesn’t that sound like a slumlord? Maybe I am missing a point here, but what kind of messages does this send to other slumlords that havn’t^[sic] been jailed or fined? It’s [the hotel] trying to be pushed through.”

Carnahan also presented signs for residents and or business owners who are opposed to the hotel, that could be placed in windows or on stakes in the yard. Some of the signs said, ‘No tell hotel’, ‘Hans off, no hotel’, ‘It takes more than a hotel to make a village’. and ‘Keep Elmwood free, no hotel’. Carnahan plans on making more signs for a protest to be held on Saturday March 18, at 2:00 p.m. (EST) on Elmwood and Forest. Some signs were given to individuals after the meeting.

“First things first, Hans is the problem, and I don’t think it has been addressed. Let’s roll back the clock on this project. What can we do with Hans? There is such thing as eminent domain, which could be of greater interest to the community, to seize the property at its lowest assessed value”, said Nancy Pollina, co-owner of Don Apparel with Patty Morris at 1119 Elmwood. “There are so many ideas that have not been explored and we are about to give this parcel away, to a big developer.”

Mobius has not returned any calls by Wikinews regarding the situation.

A freelance journalist writing for Wikinews has obtained a letter, exclusively, addressed to one of the five business owners from Hans Mobius stating:

There is a proposal to develop my property which you are currently renting. Because of opposition to this development, it does not look like it will happen. I will let you know if there any changes.

Despite the letter, there have been no plans or decisions made to end the proposal.

To date, none of the business owners or residents of 1119-1121 Elmwood have received an eviction notice.

Business owners and residents gave an indication of what they would like to see happen at the corner; a project similar to one done locally last year. There, developers renovated two buildings on Auburn and Elmwood Avenues, merging the buildings into one thus allowing for more shop space. Among some of the shops to move in after the development were Cone Five Pottery, The Ruby Slipper, and Abraham’s Jewelers. Prior to the renovation work, the left building in the picture was boarded up for several years. Many of the concerned locals would like to see a similar development on Forest and Elmwood.

Rocco Termini, a developer in Buffalo, proposed a similar design at the February 28 community meeting

In an interview after the February 28 meeting, Termini stated, “I will be willing to take a look at this myself, or I would be more than happy to be partners with Sam, Sam Savarino”, who is President and Chief Executive Officer of Savarino Construction Services Corp.

So far Savarino Construction has no plans to team up with Termini.

Constable Douglas Scott, 20, of the Royal Canadian Mounted Police (RCMP) was shot to death late Monday night while answering a call about an impaired driver. The incident took place in the community of Kimmirut in Canada’s northern territory of Nunavut.

Constable Scott, who had been on the job for six months, is the second northern Canadian RCMP officer killed on duty in just under a month. On October 6, Constable Christopher Worden was shot and killed while responding to a call in Hay River, in the Northwest Territories.

Scott is survived by his parents, Doug and Marla, as well as his siblings and grandparents. His parents live near Brockville, Ontario.

RCMP Commanding Officer “V” (Nunavut) Division Marty Cheliak expressed the police force’s shock and sadness at the shooting. “The death of any of our members is deeply felt, but when once again it occurs in one of our close-knit northern communities, the pain of that loss seems even greater,” said Cheliak in a statement. “Our hearts also go out to the community of Kimmirut and to everyone who knew Doug.”

Cheliak provided the following timeline of events:

• “At 10:56 p.m., Cst. Scott was called to respond to a complaint of a possible impaired driver.

• At 11:02 p.m. Cst. Scott radioed “V” (Nunavut) Division telecoms to say that he was following up on the call for service.

• Shortly thereafter, “V” Division telecoms attempted to contact Cst. Scott, but received no response.

• At 11:31 a second member from the detachment was advised by local residents that [the officer] had responded to a report of an impaired driver and that the driver had crashed into a residence. Upon arrival at the scene, it was found that [Constable Scott] had been shot.

• At 11:45 p.m. “V” division’s Emergency Response Team was mobilized.

• At 11:56 p.m. it was confirmed that the suspect had entered his own residence.

• At 4:10 a.m. the suspect surrendered to police without incident and was taken into custody.”

Canadian Prime Minister Stephen Harper issued a statement on the death of Scott on Tuesday. “I wish to pay tribute to Constable Doug Scott, who died tragically in the line of duty in Kimmirut, Nunavut,” said Harper. “On behalf of Canadians, I extend my sincere sympathy to the family, friends and fellow colleagues of Constable Scott. We are forever grateful that young men and women like Constable Scott continue to respond to the call of duty often working under extreme circumstances, and in conditions of great danger.”

The suspect in the shooting, Pingoatuk (Ping) Kolola of Kimmirut, Nunavut, has since been transported via RCMP aircraft to Iqaluit where he remains in custody. He has been charged with first degree murder.

In December 2005, MySpace members discovered that mentions and links to content hosted by rival video-swapping site YouTube were disabled. Debate concerning this issue was apparently even stifled on the site’s message boards. Regardless, member unrest grew, culminating in a campaign led by 600 MySpace members to boycott and relocate to rival sites such as Friendster, LinkedIn (linkedin.com), Revver, and Facebook. Subsequently, MySpace reenabled the YouTube links and content in late December. However, it appears that MySpace also closed down a blog forum where members were complaining about this issue.

MySpace was also apparently banning Revver, another video swapping site, but had relented as of early January. To this, Revver co-founder Oliver Luckett responded, “References to his service were banned because MySpace saw it as competition”.

Overall, the blocking of video stored on YouTube and other sites or embedded in user profiles has led to accusations of censorship from MySpace members. Chris DeWolfe, MySpace’s chief executive denies any this, as well as any connection between recent events and the advent of MySpace’s own video-sharing service, stating that blocking links or entire sites are sometimes necessary when MySpace investigates complaints of pornography or racism.

There has been concern among groups of bloggers operating out of MySpace that News Corp would monitor or censor their activities, ever since they purchased Intermix, then MySpace’s parent company. Ellis Yu told the Blog Herald that “their CEO said nothing like that would happen. Well, now it has. MySpace was built on an open community and now they’re trying to censor us, putting business interests above its members!”

A morbidly obese Ohio man died Wednesday after being found unconscious in his home several days earlier. The man had been sitting in a chair for two years and was physically fused to it when he was discovered by two roommates, one of which was his girlfriend.

Authorities who arrived at the house in Bellaire reported seeing the man sitting amidst his own urine and feces, which were infested with maggots. The man’s skin had become attached to the recliner’s cloth, said law enforcement officers, one of whom had to dispose of his uniform after responding to the home. In order to transport the man to the hospital, officers had to carve out a portion of the wall.

Identified as 43-year-old Richard Hughes, the man died after being taken to Wheeling Hospital in West Virginia. The residence’s landlord said Hughes, weighing 348 pounds (157 kilograms), began sitting in the chair after his knees started to hurt, and refused to get up. Hughes’ girlfriend told police that she fed him because he was unable to move around.

Jim Chase, a city official, called the room where the man stayed “very filthy, very deplorable” and said it was “unbelievable that somebody live[d] in conditions like that.”

Track Star Marion Jones, winner of 3 gold medals in the 2000 Sydney Olympics, has tested positive for the performance enhancing drug, EPO. The hormone helps create extra red blood cells which allows the user’s body to absorb extra oxygen.

Jones was expected to compete in yesterday’s Golden League meet in Zurich, Switzerland, but left early in the morning for “personal reasons.” It was announced earlier today (UTC) that she had tested positive for EPO. Jones faces a two year ban if her B test sample comes back positive.

Jones has a history of association with steroid users and dealers. In 1999, her then husband CJ Hunter tested positive for a similar drug, Nandralone. He had to withdraw from the 2000 Sydney Olympics, and received a two year ban.

Jones later divorced him, and in 2002 started a relationship with another track star, Tim Montgomery, who were both coached by Trevor Grahm.

Montgomery set a record in the 100 meter sprint of 9.78 seconds at a race in Paris that year. He was banned for two years and stripped of his record due to evidence in the Federal BALCO investigation. In the BALCO investigation, several witnesses stated that Marion Jones was taking banned substances received from BALCO.

Jones’ coach, Grahm, has been involved with 10 other athletes that tested positive and were ultimately banned for the use of illegal substances. Justin Gatlin, also coached by Grahm, also tested positive for artificial Testosterone, but has not been banned or stripped of his record.

Another American athlete, cyclist Floyd Landis tested positive for excessive levels of adrenaline after winning the Tour-de-France, which may lead to him being the first winner in the tournament’s history to be stripped of the title.

U.S. Democratic Party presidential candidate John Wolfe, Jr. of Tennessee took some time to answer a few questions from Wikinews reporter William S. Saturn.

Wolfe, an attorney based out of Chattanooga, announced his intentions last year to challenge President Barack Obama in the Democratic Party presidential primaries. So far, he has appeared on the primary ballots in New Hampshire, Missouri, and Louisiana. In Louisiana, he had his strongest showing, winning 12 percent overall with over 15 percent in some congressional districts, qualifying him for Democratic National Convention delegates. However, because certain paperwork had not been filed, the party stripped Wolfe of the delegates. Wolfe says he will sue the party to receive them.

Wolfe will compete for additional delegates at the May 22 Arkansas primary and the May 29 Texas primary. He is the only challenger to Obama in Arkansas, where a May 10 Hendrix College poll of Democrats shows him with 38 percent support, just short of the 45 percent for Obama. Such an outing would top the margin of Texas prison inmate Keith Russell Judd, who finished 18 percent behind Obama with 41 percent in the West Virginia Democratic primary; the strongest showing yet against the incumbent president. Despite these prospects, the Democratic Party of Arkansas has already announced that if Wolfe wins any delegates in their primary, again, due to paperwork, the delegates will not be awarded. Wolfe will appear on the Texas ballot alongside Obama, activist Bob Ely, and historian Darcy Richardson, who ended his campaign last month.

Wolfe has previously run for U.S. Congress as the Democratic Party’s nominee. On his campaign website, he cites the influence “of the Pentagon, Wall Street, and corporations” on the Obama administration as a reason for his challenge, believing these negatively affect “loyal Americans, taxpayers and small businesses.” Wolfe calls for the usage of anti-trust laws to break up large banks, higher taxes on Wall Street, the creation of an “alternative federal reserve” to assist community banks, and the implementation of a single-payer health care system.

With Wikinews, Wolfe discusses his campaign, the presidency of Barack Obama, corporations, energy, the federal budget, immigration, and the nuclear situation in Iran among other issues.

Space Exploration Technologies, also known as SpaceX, successfully launched their Falcon 9 rocket for the first time at 1845 UTC ( 2:45 pm EDT) from Kennedy Space Center at Cape Canaveral, Florida, United States.

The Falcon 9, second in the Falcon series of rockets, has a first stage that is powered by nine Merlin 1C engines, and a second stage powered by one Merlin vacuum engine. Today’s inaugural launch carried the Dragon Spacecraft Qualification Unit (DSQU), a boilerplate version of the Dragon capsule. The Dragon is intended to take cargo — and possibly people — to the International Space Station through NASA’s COTS program. The program is intended to help develop commercial space transportation, a goal that fits with President Obama’s recent change of direction for NASA. Under President Obama’s new plan, NASA would hand over the mundane task of Low Earth Orbit (LEO) launches to private companies, and instead concentrate on new technology development.

However, no private firms yet have the capability to independently launch humans into space, without NASA assistance. SpaceX CEO and founder Elon Musk hopes that the Falcon 9 will eventually fill the void in human rated commercial rockets, but he also recognizes the inherent risk and danger of rocket launches. “There’s nothing more fear and anxiety-inducing than a rocket launch,” said Musk.

Not everyone agrees with President Obama and Elon Musk. Republican Senator Richard Shelby doesn’t think private firms are ready for the challenge of taking humans into space, preferring that government funding be directed to NASA instead. “Today the commercial providers that NASA has contracted with cannot even carry the trash back from the space station, much less carry humans to or from space safely,” the Senator said.

Although today’s launch succeeded, Musk had said earlier neither the success nor failure of the Falcon 9 would be the ultimate arbitrator of the fate of NASA’s new commercial-friendly direction. “They sort of focus everything on us and try to create a situation where our first launch of Falcon 9 is somehow a verdict on the president’s policy, which is not right,” he said.
