Smart-1 probe ends mission with planned crash into the Moon

Observatories around the world watched the skies early on Sunday morning as a European space probe, the SMART-1 crash landed on the Moon; the first time a European made object has landed there and, as the first, it made quite a bang. For the culmination of its three-year mission the probe left its orbit around our nearest neighbor and smashed into the Lake of Excellence at around 4,500 mph. The impact created a brand new crater and scattered debris up to 30 miles, in contrast to the gentle touchdown of the Eagle lander (when Neil Armstrong became the first man on the moon) 37 years ago.

One dead after small plane crashes near Phoenix

The pilot of a small plane that crahed into a warehouse near Deer Valley Airport in Phoenix, Arizona has been confirmed dead.

The plane veered off the airport runway early Wednesday, shortly before landing, and then slammed into a pest-control building a quarter-mile away, bursting into flames. The cause of the crash is unknown, and no one knows how many passengers were in the plane. The small plane was a four-seat single-engine Cirrus SR 22, which is built out of a composite of plastics and fiberglass.

Cindy Cross, a witness of the crash, said that “there was just a horrible black plume of smoke. We knew that it had hit a building and that it was bad because it wasn’t a normal fire.”

The Deer Valley Airport serves general aviation and hosts an aviation school. It is unknown if the flight was a training flight or not.

Al Sharpton speaks out on race, rights and what bothers him about his critics

At Thanksgiving dinner David Shankbone told his white middle class family that he was to interview Reverend Al Sharpton that Saturday. The announcement caused an impassioned discussion about the civil rights leader’s work, the problems facing the black community and whether Sharpton helps or hurts his cause. Opinion was divided. “He’s an opportunist.” “He only stirs things up.” “Why do I always see his face when there’s a problem?”

Shankbone went to the National Action Network’s headquarters in Harlem with this Thanksgiving discussion to inform the conversation. Below is his interview with Al Sharpton on everything from Tawana Brawley, his purported feud with Barack Obama, criticism by influential African Americans such as Clarence Page, his experience running for President, to how he never expected he would see fifty (he is now 53). “People would say to me, ‘Now that I hear you, even if I disagree with you I don’t think you’re as bad as I thought,'” said Sharpton. “I would say, ‘Let me ask you a question: what was “bad as you thought”?’ And they couldn’t say. They don’t know why they think you’re bad, they just know you’re supposed to be bad because the right wing tells them you’re bad.”

Countries around the world send aid, help to Haiti

Countries and organizations from around the world are sending aid and help to victims of the devastating 7.0 magnitude earthquake that struck Haiti on Tuesday, damaging many buildings. The death toll is currently unknown, but estimated to run into the tens of thousands of people.

US president Barack Obama said in a press conference that “I’ve directed my administration to launch a swift, coordinated and aggressive effort to save lives and support the recovery in Haiti.”

Obama announced that aid from the US armed forces was coming to Haiti, noting, “Several Coast Guard cutters are already there providing everything from basic services like water, to vital technical support for this massive logistical operation.”

Obama continued: “[…] today, I’m also announcing an immediate investment of $100 million to support our relief efforts. This will mean more of the life-saving equipment, food, water and medicine that will be needed. This investment will grow over the coming year as we embark on the long-term recovery from this unimaginable tragedy.”

Obama said that the US would forge partnerships with Haitian people and Haitian-Americans, along with United Nations peacekeepers. He closed by saying, “To the people of Haiti, we say clearly, and with conviction, you will not be forsaken; you will not be forgotten. In this, your hour of greatest need, America stands with you. The world stands with you.”

The UN Secretary-General, Ban Ki-moon said that $10 million is being released from the international organization’s central emergency response fund.

Meanwhile, the UN’s World Food Programme (WFP), which already has an existing operation in the country, is beginning to distribute high energy biscuits which require no preparation before eating. On top of that, the WFP is airlifting 86 metric tons of food from their emergency hub in El Salvador.

A spokesperson for the WFP said, “In a normal day the World Food Programme will be feeding one or two million people in Haiti — and now we need to do even more, because the people have lost everything.”

China is also pledging aid to the country, despite the lack of official diplomatic ties between the two countries. Haiti recognizes the Republic of China, better known as Taiwan. Nevertheless, China has sent a 60 member search and rescue team to Haiti and the Chinese Red Cross is donating one million dollars in emergency aid.

Chinese Foreign Ministry spokesperson Jiang Yu said her country expresses sympathy to the Haitian government and people. Jiang says the Chinese foreign minister has sent a telegram of condolence to his Haitian counterparts.

An 80 member team from the United Kingdom of search and rescue specialists has arrived in Haiti to help in efforts there. British Prime Minister Gordon Brown said in a joint press conference with Toaiseach of Ireland Brian Cowen that the team has arrived in the country. He also announced that the government is pledging to match the UN’s US$10 million (£6.1 million).

Brown said, “It is a tragedy beyond imagination and there is a deep sense of loss felt by the whole of the British and Irish people about the tragedy that individual families in Haiti are experiencing at the moment. We send our message of sympathy and support to the people of Haiti at this most difficult of times.”

He added, “Where men, women and children are suffering under the heaviest of burdens, that place must, for that moment, become the centre of our world’s attention, the world’s compassion and the world’s humanitarian help.”

France is also sending aid to the French-speaking country, which at one time was a colony of France known as Saint-Domingue. France is sending two planes with rescuers and aid. Civil safety authorities in France are sending a team of 130 members consisting of rescuers, trained rescue dogs, doctors and nurses along with 12,000 tons of aid and rescue supplies.

Israel is sending rescue forces in two El Al planes carrying a 121-member delegation that includes 40 doctors, five search-and-rescue teams, and an army rescue squad. The IDF medical teams are preparing to spend two weeks in Haiti.

Spain has pledged $4.3 million (3 million) in aid money and has 150 tons of aid ready to be delivered.

South Africa is sending a team of search and rescue specialists to Haiti in response to the devastating earthquake on Tuesday. It is the first of several teams being sent by a local civic group.

The head of South Africa’s Gift of the Givers Foundation, Emtiaz Sooliman, says his group is sending up to three teams of search and rescue specialists to Haiti to help victims of the earthquake and hopefully save some lives.

“These are people who have worked with building collapses, urban search and rescue and some of them have been involved in responding to previous earthquakes so they are highly skilled,” he said.

Sooliman says a second team is to depart as soon as he can book a flight for it.

Zimmerman stands before judge for the Trayvon Martin shooting

George Zimmerman, the Florida neighborhood watch captain who shot African American teenager Trayvon Martin in February, stepped into court for his first appearance Thursday afternoon after his arrest the previous night. The judge found probable cause in the charges of second degree murder, but Zimmerman’s lawyer held off on making a bail request out of concern for his clients safety.

It is the search for justice for Trayvon that has brought us to this moment.

At a Wednesday evening news conference in Jacksonville, Florida, special prosecutor Angela Corey announced Zimmerman willingly turned himself in. A law enforcement official said at the time Zimmerman was in custody at the Seminole County Jail in Florida. Corey said, “It is the search for justice for Trayvon that has brought us to this moment.”

Zimmerman, 28, was involved in an altercation with the 17-year-old Trayvon Martin that led to Martin’s death the night of February 26 in Sanford, Florida. Zimmerman claimed self-defense when he shot Martin. Martin was in a gated community returning to the house he and his father were staying at carrying a pack of candy and iced tea when Zimmerman followed him and called the police to report a “suspicious” character. Since then, black leaders have demanded justice for a murder that they believe to be driven by race.

Zimmerman’s arrest and charge occurred after his lawyers announced Tuesday they were quitting the case after having no contact with him since Sunday. They also said Zimmerman was in a fragile mental state.

In Florida, a person charged with second-degree murder can spend life in prison, and the charge is usually when a confrontation ends with the death one of the parties involved. Florida also has a Stand-your-ground law, which means people can use deadly force in cases of self-defense, which is expected to play a major role in the case. In the United States, 24 states, including Florida, have such a law while the other 27 states do not. The National Rifle Association pushed for the law’s passage in Florida seven years ago.

Trayvon Martin’s parents, Tracy Martin and Sybrina Fulton, have been publicly calling for Zimmerman to be prosecuted. They appeared at a press conference after the special prosecutor’s announcement with Reverend Al Sharpton in Washington, D.C. Fulton said, “We simply wanted an arrest. We wanted nothing more and nothing less, we just wanted an arrest. And we got it.”

Zimmerman’s lawyer Mark O’Mara has already signaled that his client will plead not guilty at a future hearing which the judge set for May 29, but he also expects to request bail for his client once safety details are worked out.

Commonwealth Bank of Australia CEO apologies for financial planning scandal

Ian Narev, the CEO of the Commonwealth Bank of Australia, this morning “unreservedly” apologised to clients who lost money in a scandal involving the bank’s financial planning services arm.

Last week, a Senate enquiry found financial advisers from the Commonwealth Bank had made high-risk investments of clients’ money without the clients’ permission, resulting in hundreds of millions of dollars lost. The Senate enquiry called for a Royal Commission into the bank, and the Australian Securities and Investments Commission (ASIC).

Mr Narev stated the bank’s performance in providing financial advice was “unacceptable”, and the bank was launching a scheme to compensate clients who lost money due to the planners’ actions.

In a statement Mr Narev said, “Poor advice provided by some of our advisers between 2003 and 2012 caused financial loss and distress and I am truly sorry for that. […] There have been changes in management, structure and culture. We have also invested in new systems, implemented new processes, enhanced adviser supervision and improved training.”

An investigation by Fairfax Media instigated the Senate inquiry into the Commonwealth Bank’s financial planning division and ASIC.

Whistleblower Jeff Morris, who reported the misconduct of the bank to ASIC six years ago, said in an article for The Sydney Morning Herald that neither the bank nor ASIC should be in control of the compensation program.

Major US bankruptcy reform bill signed into law

U.S. President George W. Bush signed into law Wednesday a major bankruptcy reform bill, making the most sweeping changes to the laws of personal bankruptcy in the past two decades. Bill S.256 is predicted to reduce the chances of filing Chapter 7 bankruptcy for 30,000 to 210,000 families per year, according to the American Bankruptcy Institute.

The legislation was strongly opposed by some consumer advocates and by some Democrats in Congress, who complained about the lack of debate on exemptions they attempted to introduce and tried to derail the passage of the bill. Those who are unable to file for Chapter 7 bankruptcy will then be forced to file under Chapter 13, which requires payment of some debts by order of a judge based on the financial resources of the debtor.

Opponents said the bill will end a chance for a fresh start in the financial lives of the American people by keeping them in debt to collection agencies, as well as credit card companies and banks who have made it easy to obtain high credit limits amid mounting consumer debt.

In his remarks before signing the bill, which he supported, Bush said, “The bipartisan bill I’mabout to sign makes common-sense reforms to our bankruptcy laws. By restoringintegrity to the bankruptcy process, this law will make our financial systemstronger and better. By making the system fairer for creditors and debtors,we will ensure that more Americans can get access to affordable credit.”

The bankruptcy bill received a 302-126 approval in the house, after receiving a 74-25 vote in the Senate last month following strong, mostly partisan debate.

The US bankruptcy system was established in 1898. It allowed judges and debtors to come to terms with the costly medical bills that can follow a relative’s death, or a family illness. Such cases form nearly half of all bankruptcies filed in the USA, according to the American Bankruptcy Institute.

Now many of those people will have to work out repayment plans suitable to creditors instead of having debts erased by a judge, according to the new law, which takes effect in six months.

In the past, a judge or court representative would calculate an individual’s income and subtract necessities of life to come up with a practical repayment plan of some debt. The new law stipulates that a graph, showing the poverty level in whichever state the consumer is living will be the criteria. It assumes that if people can subsist at that poverty level, then everything over that can be used to repay creditors.

Additionally, a provision that allowed debtors to file their own Chapter 7 fresh start bankruptcy has been changed to require a lawyer, paid by the debtor, to do the filing.

The new law also erased “usury” provisions in lending laws, with some lawmakers saying that paying 30 percent interest was not too much when a debtor was behind on payments.

But Bush said that credit will “be more affordable because when bankruptcy is less common, credit can be extended to more people at better rates,” meeting demands of the credit card companies which they have been pressing for the last eight years.

“The big winners under the new law will be the special interests that literally wrote it, particularly the credit card industry,” said Travis B. Plunkett, legislative director of the Consumer Federation of America. “This is particularly ironic because reckless and abusive lending practices by credit card companies have driven many Americans to the brink of bankruptcy.”

The forces arrayed on the losing side of this bill said it will hurt low-income working people, single mothers, minorities, and elderly and will end a safety net for people who have lost jobs or face major medical bills. People who fail (refuse) to pay or refuse to go to court will punished by a fine and or arrest warrant made out in their name. About fifty thousand Americans will be punished by a fine and or warrant about three thousand Americans every year will go to jail under the new bankruptcy law. For some people this will be a third strike so they will be put in jail for life.

But Mallory Duncan, a lawyer for the National Retail Federation, said “Bankruptcy has gone from a stigma to a financial planning tool for many.”

New personal bankruptcy filings have increased from 172,423 in 1978 to 1,599,986 last year, an increase of 828% during that time; however, it edged down slightly last year.

About 2 percent to 13 percent of those who dissolve their debts in Chapter 7 bankruptcy each year in exchange for forfeiting some assets will be disqualified from doing so under the law, according to the American Bankruptcy Institute.

Bankruptcy lawyers anticipate a rush to the courthouse to beat the six-month window before the new reforms take effect.
