Science fiction author Harlan Ellison announced, in a press release dated March 13, 2009, that he is suing television company CBS Paramount Television for failure to pay residuals to Ellison for the Star Trek episode “The City on the Edge of Forever“. Ellison is also suing writers’ union the Writers Guild of America, west (WGA), of which he is a member, for failing to diligently pursue Ellison’s royalties from Paramount.

In a strongly and colorfully worded press release, Ellison and his lawyer alleged that Paramount had failed to pay the author, who wrote the 1967 television episode under the pseudonym “Cordwainer Bird”, royalties on derivative works such as tie-in novels based on the story as well as merchandise based on the episode such as a 2004 talking Christmas ornament which recited lines from the episode.

The suit comes two months before the release of a film, titled simply “Star Trek“, which will re-launch the longstanding multimedia science-fiction franchise. The film will be the first original, official Star Trek video material since the series “Star Trek: Enterprise” was canceled in mid-2005. CBS Paramount is also gearing up for the April release of the first series of Star Trek, including “City on the Edge of Forever”, on Blu-Ray high-definition disc.

Ellison, however, states: “And please make sure to remember, at the moment some Studio mouthpiece calls me a mooch, and says I’m only pursuing this legal retribution to get into their ‘deep pockets,’ tell’m Ellison snarled back, ‘F- – – -in’-A damn skippy!’ I’m no hypocrite. It ain’t about the ‘principle,’ friend, its[sic] about the MONEY! Pay Me! Am I doing this for other writers, for Mom (still dead), and apple pie? Hell no! I’m doing it for the 35-year-long disrespect and the money!”

The suit is not the first time contention has arisen between Ellison and Star Trek since he wrote the episode. In 1995 the author, in the book Harlan Ellison’s The City on the Edge of Forever, accused Star Trek creator Gene Roddenberry of “demented lies” about the episode. He also stated at the time: “I’ve never seen more than a pittance from ‘The City on the Edge of Forever,’ while every thug and studio putz and semiliterate bandwagon-jumper and merchandiser has grown fat as a maggot in a corpse off what I created.”

Roddenberry, who died in 1991, stated in numerous interviews that Ellison’s original script was unsuitable for reasons of content and budget, and rewrote it heavily; a dissatisfied Ellison chose to have a pseudonym appear on the final version. The episode as aired won the 1968 Hugo Award for Best Dramatic Presentation, while Ellison’s original script won a Writers Guild of America Award for Best Dramatic Hour-Long Script.

Ellison’s suit against the WGA West, meanwhile, is for the symbolic amount of one dollar. He asserts he is seeking “a judicial determination as to whether the WGA is doing what its stated purpose has been since day-one! To fight and negotiate for him and other writers. To obtain misappropriated, withheld, hidden earnings, no matter how minuscule or difficult to retrieve – but HIS, nonetheless.” Ellison took part in picketing during the 2007–2008 Writers Guild of America strike.

Requests for comment from CBS-Paramount and the WGA were not returned.

Harlan Ellison became established in the science fiction community in the 1950s and won awards and acclaim for short work such as the 1969 novella “A Boy and his Dog” and the 1967 short story “I Have No Mouth, and I Must Scream“. He has also been the plaintiff in several high-profile lawsuits, suing a person who posted some of his copyrighted work on Usenet along with the ISPs hosting the work in 2000 and in 2006 suing Fantagraphics for defamation; Ellison won the first lawsuit and settled the second. Also in 2006, he controversially groped the breast of fellow author Connie Willis at the 64th World Science Fiction Convention in Los Angeles during the presentation of Willis’s Hugo Award; Ellison later apologized for the incident.

Victoria Wyndham was one of the most seasoned and accomplished actresses in daytime soap opera television. She played Rachel Cory, the maven of Another World‘s fictional town, Bay City, from 1972 to 1999 when the show went off the air. Wyndham talks about how she was seen as the anchor of a show, and the political infighting to keep it on the air as NBC wanted to wrest control of the long-running soap from Procter & Gamble. Wyndham fought to keep it on the air, but eventually succumbed to the inevitable. She discusses life on the soap opera, and the seven years she spent wandering “in the woods” of Los Angeles seeking direction, now divorced from a character who had come to define her professional career. Contact the right person

Be firm

Make it clear that you expect payment for the products or service that the debtor has purchased from you. You have fulfilled your side of the contract by providing the services and goods and you have every right to expect payment for it.

Be professional

Though communicating with difficult debtors can be aggravating, as a professional you need to be keep your cool at all times. You must be patient and firm. Adopting a professional and impersonal attitude helps. Do not shout, even raise your voice, abuse or threaten the debtor, on any account.

Be focussed

The debtor may try to divert you from the problem on hand by discussing personal stories and making innumerable excuses. You must keep a tight rein on the conversation at all times, and bring it back to the purpose of the meeting – to collect payment or get a commitment for the payment.

Ask questions

Interrogate the debtor on the excuses made for not paying the debt. Asking lots of questions forces the debtor to come up with believable answers and in the barrage of stories, the truth can just slip out. The debtor usually hopes that the lies will be accepted without question. Persistent questioning makes debtors uncomfortable, as they have to keep coming up with more lies to support their excuses. Avoiding a repeat performance of the interrogation prompts debtors into settling the payment.

Report debtor to credit rating agencies

Sometimes, none of the above measures will show results. This happens when the debtor is exceptionally stubborn. Inform debtors that you are being forced to report them to a major credit rating agency. Reporting debtors to credit rating agencies will affect their chances of getting credit for up to 7 years. Sometimes, the threat works and the debtor may pay up. Otherwise, you must follow the warning with action and report the debtor to the credit bureau.

Litigation

Litigation is the last resort. Warn the debtors of your intention of filing a lawsuit against them. If they do not heed the warning and pay up, make sure you follow through and file a lawsuit. This will make the debtor take collection attempts seriously and it will affirm your credibility.

Collecting debt from difficult debtors is an unpleasant and arduous task. However, it needs to be done. Patience, focus, persistence and professionalism are required to handle these debtors. Warnings must always be followed by action to ensure the debtor takes collection proceedings seriously and pays the debt.

South Korea: Fire in hospital housing elderly people kills at least 37

Fire broke out on Friday morning and destroyed the bottom two floors of a six-story hospital in Miryang, South Korea, killing at least 37 people, most of them elderly. More than a hundred injuries were reported, with eighteen people in critical condition. This is the highest death toll from fire in South Korea in almost a decade.

The fire is believed to have started at about 7:30 local time, according to fire chief Choi Man-woo. It originated on the ground floor in the emergency room as per various officials. The hospital has 98 beds and a medical staff of about 35, and specializes in long-term care of elderly patients. It adjoins a nursing home, all of whose 94 residents were evacuated. Staff carried some patients out of the hospital on their backs.

One patient, Jang Yeong-jae, who told his story to JoongAng Ilbo, said he escaped by removing a screen from a window to get to a ladder placed by firefighters. He described people “running around in panic, falling over and screaming as smoke filled the rooms”. The majority of the victims died from smoke inhalation and are believed to be elderly, said the head of the city’s public hospital, Chun Jae-kyung. A doctor, a nurse, and a nursing assistant have died, according to the fire service; it took three hours to put out the fire.

In a press briefing, Seok Gyeong-sik, the director of the hospital, apologized to patients and their families. Son Kyung-chul, its chairman, stated that there were no sprinklers because the facility was small. Sprinklers are being installed in the nursing home, where a new law requires them by June 30.

Last month, 29 people died in a fire in a gym in Jecheon; the owner and the manager were arrested for safety violations. In 2014, a blaze in a nursing home in Jangseong left 21 dead. The President of South Korea, Moon Jae-in, responded to the Friday fire by calling an emergency meeting of his staff, and promised that the cause would be found rapidly “to prevent the recurrence of the fire in the future”.

Obama offers sympathies to Fengshen victims

The presumptive Democratic Presidential nominee and Illinois state senator Barack Obama conveyed his sympathies and condolonces to the people of the Philippines through President Gloria Arroyo, after the country was struck over the weekend by Typhoon Fengshen.

Obama also extended his regrets for not being able to meet Mrs. Arroyo who is on a 10-day official visit in the United States and met up with President George W. Bush at the White House.

The senator from Illinois stressed the strong bond between the Philippines and the United States, taking note of the two countries partnership during the Cold War era and during the Second World War. Obama also pointed out that the Philippines is also an important ally in the on-going war on terror.

He also expressed his desire on meeting Arroyo in the future and working closely with the people of the Philippines.

He also urged the Bush administration to provide more aid to the Philippines in the wake of the retrieval of victims of Typhoon Fengshen who drowned or were lost at sea.

Obama urged the “US government to provide emergency support to alleviate the suffering caused by the catastrophic natural disaster.”

Typhoon Fengshen lashed through the islands of the Philippines last June 21 to 22 causing mud floods, landslides and the capsizing of a passenger ferry, the MV Priness of the Stars, killing more than 700 passengers on board off the coast of Romblon island.

The National Disaster Coordinating Agency of the Philippines reported that five days after the ferry tragedy, only 48 passengers survived and rescuers were able to retrieve 67 bodies.

Transportation and Communications Secretary Leandro Mendoza also reported that 138 fishing vessels were reported missing as a result of Typhoon Fengshen.

A cargo vessel, the MV Lake Paoay carrying 5,000 metric tons of coal from the mines in Semirara island was also lost off the coast of Iloilo province.

Getting even with the law: Wikinews interviews New York City’s ‘Jimmy Justice’

“What bothers me is watching an officer write someone a summons and then commit the exact same violation with their official vehicle.

A civilian known as ‘Jimmy Justice’ who resides in New York City (NYC), New York, the largest city in the United States, has been videotaping NYC police officers and city workers, breaking the law while on the job.

Since 2007, he claims to have caught “hundreds of officers and other city employees violating the law,” and says he has them all on camera. He has posted his best confrontations with them to the video sharing website YouTube. As a result, Justice states that he has been asked to do a United States television show and Wikinews got an exclusive interview with him. For protection, Justice wished not to be called by his real name in fear of police retaliation.

Last year, Justice videotaped a police officer parking in front of a fire hydrant, but has only recently gained attention on social networking news sites such as Digg and reddit.com. So Wikinews contacted Mr. Justice, known as JimmyJustice4753 on YouTube, for an exclusive interview to find out what caused him to get revenge on the law.

On June 30, 2007, Justice caught officer E. Anderson of the NYPD, traffic division, parking directly in front of a fire hydrant while she went inside a restaurant to take a 15 minute lunch break.

“Do you think there is something wrong with parking a vehicle, blocking a fire hydrant,?” says Justice while following Anderson to her car after her meal.

“Mrs. Anderson I’m talking to you,” says Justice as Anderson ignores him. “You parked your vehicle blocking a fire hydrant. You are not allowed to do that. Somebody else would get a ticket for that. Why are you allowed to do it? You should be ashamed of yourself Mrs. Anderson.”

By this time, the incident has gained the interest of people nearby the scene and passing it. One unidentified woman, who claims to be a retired NYC police officer decides to intervene stating that people “are not supposed to film any police, [or] anybody employed with the police department because of the terrorism.” A short time later the woman walked off camera.

Since 2007 Justice says he has caught “hundreds of law enforcement officers and city officials” on “over 30 hours of video” violating laws from illegal U-turns in business districts to blocking bus stops and fire hydrants. Justice has only uploaded the “most colorful ones to YouTube” and recently, on April 8, 2008, Justice videotaped a NYPD tow truck officer blocking a hydrant while he also ate lunch inside a restaurant. According to NYC law, it is illegal for any vehicle to park within 15 feet of a fire hydrant and to park in front of a bus stop. It is also illegal for any person to make a U-turn in a business district. Fines for these violations can cost a driver up to US$115.00 for each violation occurred.

When Wikinews asked Justice why he decided to start filming the violations made by officials he answered, “what bothers me is watching an officer write someone a summons and then commit the exact same violation with their official vehicle. I started making these videos to remind the officers (and complacent civilians) that City employees have to abide by the same laws that they are paid to enforce. I plan on doing this and inspiring others to do this as well as a means of leveling the playing field against discourteous officers.”

“In NYC, the traffic cops are notorious for their draconian indiscretion in handing out summonses to civilians for petty violations. Obviously the laws are not enforced as a matter of public safety, but rather to raise revenue,” added Justice.

Justice makes little effort to get the violations on videotape saying “all I have to do to catch them is open my eyes.”

“The problem with abuse of authority is rampant in New York City. I take my video camera with me on the way to work and on the way to social events and band rehearsals and when I see action it takes me less than 4 seconds to have the camera out and in record mode,” states Justice.

His videos have drawn the attention of media and he has been featured on ABC’s ‘I-caught videos’ and Inside Edition. Justice also states that the popularity of his videos have gotten the attention producers in Hollywood, California and as a result, there are plans for a television show.

Since Justice began getting even with officials and their violations, he states that there has been a positive change in the communities.

“The publicity my videos have received has effected positive change in the community, but we still have a long road ahead of us,” added Justice.

As a result of his videos, at the time the NYPD launched an investigation into the violations, but it is not known if any officers were charged or punished. Justice himself has never been arrested, but has been assaulted.

“I have never been arrested for this yet but they have threatened me with arrest. I have been spit on, cursed at, assaulted, and I had 2 cameras broken already,” added Justice.

US: Evidentiary documents released in Golden State Killer case

On Friday, the federal court of the city of Sacramento, California in the United States, with Judge Michael Sweet presiding, publicly released 123 out of the 800 pages of evidence planned for use in the the trial of 72-year-old Joseph DeAngelo, in the Golden State Killer (GSK) case, all heavily redacted. DeAngelo is charged with twelve counts of first degree murder with special circumstances, and is being investigated for the additional first degree murder of Claude Snelling in 1975.

From 1974 to 1986, there were 12 murders, 50 rapes, and 120 burglaries that have been attributed to the Golden State Killer. Many of these crimes were initially attributed to separate suspects, and California investigative teams coined such nicknames as “East Area Rapist”, “Original Night-stalker”, “Visalli Ransacker”, and “Diamond Knot Killer”. All these identities were later determined to be the GSK.

GSK’s alleged victims include 18-year-old Janelle Lisa Cruz on May 4, 1986; 35-year-old Cheri Domingo on July 27, 1981; 27-year-old Greg Sanchez on July 27, 1981; 24-year-old Keith Harrington on August 21, 1975; 27-year-old Patti Harrington on August 21, 1975; 21-year-old Brian Maggiore on February 2, 1978; 20-year-old Katie Maggiore on February 2, 1978; 44-year-old Dr. Robert Offerman on December 30, 1979; 35-year-old Debra Manning on December 30, 1979; 35-year-old Lyman Smith on March 13, 1980; 33-year-old Charlene Smith on March 13, 1980; 45-year-old Claude Snelling on September 11, 1975; and 28-year-old Manuela Witthuhn on February 5, 1981.

Law enforcement used DNA and other evidence to link the twelve known murders attributed to the GSK to suspect DeAngelo. Any DNA from rape kits and burglaries that predates 1970 is only admissible in court for murder cases because of California’s statute of limitations. The DNA evidence allegedly implicating DeAngelo was not found through the Federal Bureau of Investigation (FBI)’s Combined DNA Index System (CODIS) database, which catalogs 20 sections of DNA from local, state, federal, and some international agencies making a unique profile for 16 million individuals, but CODIS did rule out other GSK suspects, like Paul “Cornfed” Schneider and Joe Alsip.

Instead, law enforcement used a nuance investigative technique, comparing GSK’s DNA profile against the open-sourced GEDmatch’s genealogical DNA database. The GEDmatch’s database flagged a GSK blood relative and, with other evidence, DeAngelo was suspected of being involved with GSK’s crimes. The genealogical website methodology is not unique to the GSK case. GEDmatch’s database was also used to identify 51-year-old William Earl Talbott II in the 1987 rape and homicide of Jay Cook (20) and Tanya Van Cuylenborg (18) in Seattle, Washington.

The newly released documents reveal DeAngelo’s DNA was not collected via a warrant but rather from the door handle of his personal vehicle as he was shopping in a local Hobby Lobby on April 18. A secondary sample was collected from a tissue found in the garbage on April 23. The door handle and tissue DNA were compared to a semen sample from a known GSK murder that had been confirmed using the CODIS’s 20 section DNA profile standard. On April 24, DeAngelo was arrested for the twelve GSK murders. A warrant for DeAngelo’s Citrus Heights, California residence disclosed dozens of wedding rings, photographs, driver’s licenses, and other objects allegedly taken from victims as trophies.

Public defender David Lynch, tasked with defending DeAngelo, motioned for the 800 documents to be sealed until trial to prevent the jury from becoming tainted. Lynch has also questioned the validity of certain search warrants for undisclosed reasons. Prosecutors from Sacramento, Ventura, Orange, and Santa Barbara counties have not determined the best way to prosecute DeAngelo considering the complexity, age, and multiple jurisdictions of the case.

DeAngelo was a police officer operating in small towns in California until 1979. After allegedly stealing a hammer and dog repellent, DeAngelo was subsequently fired from the Auburn, California police force. He later became a truck mechanic near Sacramento.

Edmund White on writing, incest, life and Larry Kramer

What you are about to read is an American life as lived by renowned author Edmund White. His life has been a crossroads, the fulcrum of high-brow Classicism and low-brow Brett Easton Ellisism. It is not for the faint. He has been the toast of the literary elite in New York, London and Paris, befriending artistic luminaries such as Salman Rushdie and Sir Ian McKellen while writing about a family where he was jealous his sister was having sex with his father as he fought off his mother’s amorous pursuit.

The fact is, Edmund White exists. His life exists. To the casual reader, they may find it disquieting that someone like his father existed in 1950’s America and that White’s work is the progeny of his intimate effort to understand his own experience.

Wikinews reporter David Shankbone understood that an interview with Edmund White, who is professor of creative writing at Princeton University, who wrote the seminal biography of Jean Genet, and who no longer can keep track of how many sex partners he has encountered, meant nothing would be off limits. Nothing was. Late in the interview they were joined by his partner Michael Caroll, who discussed White’s enduring feud with influential writer and activist Larry Kramer.
