Polish exercise book advertisement copies Wikipedia content, violates copyright

On August 21, the Polish weekly Przekrój published an advertisement for Dan-Mark exercise books, bearing the logo of 4fun.tv, a Polish music/interactive TV station. Part of the advertisement contained a definition of the word “exercise book”. The wording looked familiar, and Wikinews consulted Wikipedia, the collaborative online encyclopedia.

Upon seeing the Wikipedia definition, it appeared that the entry quoted in the promotional material was identical to the initial two paragraphs of the relevant Wikipedia entry.

Freelance reporters for the Polish Wikinews decided to find out the reason for such a similarity and whether either of the texts (the advertisement’s or Wikipedia’s) might be a case of copyright violation.

The reporters contacted a Jaros?aw Janas, Creative Director of 4fun.tv., where the ad appeared. His reply included the following claim:

The text of the definition has been taken from an encyclopedic publication which is older than 50 years and therefore not subject to copyright protection. The fact of coincidental similarity cannot be considered equal to plagiarism, because as we all know Wikipedia is a place which publishes texts and definitions that have already existed in different forms in other publications released before.

Copyright on text does not last for fifty years as claimed by Janas, but for 70 years after the death of the author.

To investigate the authenticity of the above claims, Wikinews asked the main author of the two paragraphs in question, Wikipedian Julo, about the sources used to write the entry. He confirmed that he had written the text in question, and not copied it from an encyclopedic publication as claimed by Jana.

It is therefore impossible that both Julo and the people responsible for the exercise book advertisement have used the same uncopyrighted encyclopedia, thus coincidentally creating identical texts. The reporters also noted that the first draft of the introduction to the article was written by WaldemarWolskiHuta (February 2006). Afterward the text had undergone some modifications by Julo (September 2006), as well as Picus viridis and Beno (March 2008). However, the text presented in the press promotional material, which – according to 4fun.tv – came from an old-print encyclopedia is identical to the Wikipedia entry after the changes mentioned above had been made. Julo added that he was still alive, together with the other authors of the article in question who constituted the group of the copyright co-holders. This naturally led to a conclusion that neither 50 nor 70 years could have passed since their death. He left 4fun.tv’s actions with a comment that although the contents he and the other Wikimedians had made public and free, they are far from making them available in any “free style”, but under a specified license.

In follow up messages to Jaros?aw Janas, Wikinews reporters confronted the creative director over his seemingly inaccurate claims.

Wikinews was told in a reply that 4fun.tv would ignore the claims unless they see permission from the author of the original content to investigate this story. They were also informed that further e-mails without any specifics sent by the reporter would be qualified as spam. 4fun.tv’s creative director further added that he found the reporter’s picture on the Internet and asked how the person would feel if this picture was to appear on billboards or press releases that advertised the TV station.

Wikipedia does allow copying of its content under certain conditions. The encyclopedia’s content is released under the GNU Free Documentation License, which means that it can be copied, modified, and used commercially and non-commercially – under the conditions that the license’s text is included with the copied content and the five main authors are mentioned. If a part of the article is used, like in the example quoted in this news story, a “right to quote”, recognized by Polish law, may be used. In such a case it suffices to mention the source of the text (Polish Wikipedia) and the author of the excerpt. 4fun.tv met none of these conditions, meaning that copyright has been violated.

Over a year ago Polish Wikinews reported on a similar problem, regarding the use of free-licensed photographs. Since that time such “borrowings” have become less frequent, however photos are still being used in discordance with the license. Journalists have gotten used to citing sources, e.g. Wikipedia, although licensing conditions require attributing the actual author, not the source. So instead of attributing John Doe for his contribution, agencies like Polska Agencja Prasowa (Polish Press Agency) are attributing the source, Wikipedia.

In early September 2008 a similar situation occurred in relation to the Polish edition of Wiktionary. Gazeta Wyborcza, a Polish daily, published an IKEA advertisement, on the opening page of which an almost word-for-word Wiktionary entry was placed; additionally the advertisement used the characteristic MediaWiki layout. The reference to the external source used was missing.

In April 2008, an example of an Australian professor was cited; the scientist, in a reply to a news story, quoted a Wikipedia definition almost word-for-word. The same professor condemned the use of Wikipedia in his previous press appearances.

In 2005 Wikipedia material was discovered in the German weekly magazine Der Spiegel, which acknowledged its fault and published appropriate apologies in place of the article in the online edition.

Frontline magazine in 2007 was found using an image from Wikipedia without proper credit. When pointed out the magazine acknowledged the failing and a correction was promptly given in the subsequent issue.

Semi truck crashes into viaduct in Buffalo, New York

Buffalo, New York —According to police in Buffalo, New York, no one was injured after a semi-trailer truck carrying paper from Ontario, Canada hit a railroad viaduct, tearing the truck in half.

At approximately 11:00 p.m. EDT (UTC-4) on April 21, an unidentified man driving the truck westbound on Walden Avenue between Wasmuth and Roetzer streets hit the viaduct which tore his truck in half sending debris and cargo over most of the road.

Police describe the truck’s cabin as a “can of sardines.”

“He made it all the way through, but his truck looks like a can of sardines,” said officers on police radio communications who were on scene.

The driver was given a traffic citation and admits he did not notice signs posted along Walden which state the bridge’s clearance.

The street and the viaduct remained closed into the early morning hours of Tuesday April 22. According to Don Poleto of the city’s Public Works office, the bridge was not damaged.

He has been the subject of numerous newspaper articles, and has published public policy papers exploring solutions to American issues.

Canadian jail inmates used nail clippers to escape, report finds

According to a government report released on Tuesday, six inmates of a Regina, Saskatchewan jail managed to escape last summer after spending four months using nail clippers and other makeshift instruments to break out.

The report stated that no fewer than 87 prison guards had supervised the inmates’ unit, but did not discover the prisoners’ escape plans.

The inmates, four of whom had faced murder charges, used the instruments to remove a steel plate and grill, and finally break through with a shower rod, reaching an exterior brick wall. The inmates used sheets and blankets to climb up the exterior walls of the compound.

Some of the prisoners played cards at a table in the corridor to block the guards’ view.

The prisoners were later caught and sent back to prison. “We didn’t think we would get away with it. We started working on it. It was something to do and we just kept at it. When we didn’t get caught, we picked our night and just went,” said one of the escapees to the team investigating the incident.

FDA issues proposed rules requiring calorie content on menus

The US Food and Drug Administration (FDA) has issued proposed calorie labeling rules requiring most retail food vendors to display the calorie counts in items on their menus and menu boards. The proposed rules, issued Friday and expected to be finalized in 2012, would apply to most restaurants, snack bars, vending machines, coffee shops, drive-through restaurants, and convenience and grocery stores.

The US Congress required the rules in the health-care reform law passed in 2010. The rules proposed by the FDA must undergo a public comment period before they are finalized and take effect, said Michael R. Taylor, Deputy Director for Foods at the FDA.

The proposed regulations pertain to businesses devoting more than 50 percent of their floor space to the sale of food or that consider themselves restaurants, specifically food-selling chains with at least 20 stores nationally. Included are candy stores, bakeries, and ice-cream parlors.

The FDA’s proposed guidelines specify that chains post the calorie counts of foods and drinks on menus and menu boards or next to the food item, such as at a salad bar. The menu is to prominently exhibit the calorie content of each item in a way customers can see easily, giving them the same information packaged foods prepared at home currently provide. The information must be displayed in “clear and conspicuous” print and colors.

Giving consumers clear nutritional information makes it easier for them to choose healthier options that can help fight obesity and make us all healthier.

Many cities and states have passed laws requiring calorie labeling on menus, beginning with New York City in 2008. California implemented a similar law in January, although many counties are waiting for the release of the federal guidelines before they begin enforcement. Some fast-food chains there, such as McDonald’s and Starbucks, are displaying calorie counts on menus in some of their stores.

The rules are intended to curb the national obesity epidemic since, according to FDA estimates, one third of the calories people consume yearly come from food eaten out. In a statement issued yesterday, Kathleen Sebelius, Secretary of Health and Human Services said, “Giving consumers clear nutritional information makes it easier for them to choose healthier options that can help fight obesity and make us all healthier.”

Excluded from the rules are businesses whose primary product is not food sales but that sell it, such as bowling alleys, airports and airplanes, amusement parks, hotels and movie theaters. Alcohol is also excluded.

Saddam Hussein ‘forced’ back to trial

Saddam Hussein, who had been on hunger strike, has said in his trial today that he was taken to court from his hospital bed against his will.

The former leader of Iraq was rushed to hospital last Sunday after refusing to eat for sixteen days. But according to news agencies, he has ended the hunger strike by eating lunch at the court in Baghdad. “Saddam ate beef and rice and cola with bread which he brought from hospital,” one source told Reuters news agency. He was fasting with three co-defendants, and they were demanding more security for their defence lawyers, three of whom have been murdered.

While Hussein was being treated by doctors in hospital on Monday, the trial recommenced without him. But today, he appeared in front of the court, looking slightly thinner. “I was brought against my will directly from the hospital… the Americans insisted that I come against will. This is not fair,” he claimed. “Three days ago I was taken to hospital and today I was brought here forcibly from the hospital. I was fed intravenously.”

He also said later on in the hearing that if he was found guilty and faced execution, he would prefer to be shot rather than hanged. “I advise you as an Iraqi, if you were in a circumstance in which you have to issue a death penalty, you have to remember that Saddam is a military man and in this case the verdict should be death by shooting not by hanging.”

As his defence team has been boycotting the trial, replacement lawyers have been selected by the court. However, Hussein has dismissed the representatives brought in to defend him. “Your honour, I refuse to appear before this tribunal, but this tribunal can do as it wills,” he added.

In response, Judge Abdel Rahman said: “Your lawyers were informed of the hearing and they chose not to come, despite the fact they have billions of dollars and sit in a neighbouring country, where they incite violence.” Most of Hussein’s legal team is based in Amman, the capital of Jordan.

Saddam Hussein and seven co-defendants are on trial charged with crimes against humanity after Hussein allegedly ordered his military forces to kill 148 people from the village of Dujail following an attempted assassination of the former dictator in 1982.

Saturn moon Enceladus may have salty ocean

NASA’s Cassini–Huygens spacecraft has discovered evidence for a large-scale saltwater reservoir beneath the icy crust of Saturn’s moon Enceladus. The data came from the spacecraft’s direct analysis of salt-rich ice grains close to the jets ejected from the moon. The study has been published in this week’s edition of the journal Nature.

Data from Cassini’s cosmic dust analyzer show the grains expelled from fissures, known as tiger stripes, are relatively small and usually low in salt far away from the moon. Closer to the moon’s surface, Cassini found that relatively large grains rich with sodium and potassium dominate the plumes. The salt-rich particles have an “ocean-like” composition and indicate that most, if not all, of the expelled ice and water vapor comes from the evaporation of liquid salt-water. When water freezes, the salt is squeezed out, leaving pure water ice behind.

Cassini’s ultraviolet imaging spectrograph also recently obtained complementary results that support the presence of a subsurface ocean. A team of Cassini researchers led by Candice Hansen of the Planetary Science Institute in Tucson, Arizona, measured gas shooting out of distinct jets originating in the moon’s south polar region at five to eight times the speed of sound, several times faster than previously measured. These observations of distinct jets, from a 2010 flyby, are consistent with results showing a difference in composition of ice grains close to the moon’s surface and those that made it out to the E ring, the outermost ring that gets its material primarily from Enceladean jets. If the plumes emanated from ice, they should have very little salt in them.

“There currently is no plausible way to produce a steady outflow of salt-rich grains from solid ice across all the tiger stripes other than salt water under Enceladus’s icy surface,” said Frank Postberg, a Cassini team scientist at the University of Heidelberg in Germany.

The data suggests a layer of water between the moon’s rocky core and its icy mantle, possibly as deep as about 50 miles (80 kilometers) beneath the surface. As this water washes against the rocks, it dissolves salt compounds and rises through fractures in the overlying ice to form reserves nearer the surface. If the outermost layer cracks open, the decrease in pressure from these reserves to space causes a plume to shoot out. Roughly 400 pounds (200 kilograms) of water vapor is lost every second in the plumes, with smaller amounts being lost as ice grains. The team calculates the water reserves must have large evaporating surfaces, or they would freeze easily and stop the plumes.

“We imagine that between the ice and the ice core there is an ocean of depth and this is somehow connected to the surface reservoir,” added Postberg.

The Cassini mission discovered Enceladus’ water-vapor and ice jets in 2005. In 2009, scientists working with the cosmic dust analyzer examined some sodium salts found in ice grains of Saturn’s E ring but the link to subsurface salt water was not definitive. The new paper analyzes three Enceladus flybys in 2008 and 2009 with the same instrument, focusing on the composition of freshly ejected plume grains. In 2008, Cassini discovered a high “density of volatile gases, water vapor, carbon dioxide and carbon monoxide, as well as organic materials, some 20 times denser than expected” in geysers erupting from the moon. The icy particles hit the detector target at speeds between 15,000 and 39,000 MPH (23,000 and 63,000 KPH), vaporizing instantly. Electrical fields inside the cosmic dust analyzer separated the various constituents of the impact cloud.

“Enceladus has got warmth, water and organic chemicals, some of the essential building blocks needed for life,” said Dennis Matson in 2008, Cassini project scientist at NASA’s Jet Propulsion Laboratory in Pasadena, California.

“This finding is a crucial new piece of evidence showing that environmental conditions favorable to the emergence of life can be sustained on icy bodies orbiting gas giant planets,” said Nicolas Altobelli, the European Space Agency’s project scientist for Cassini.

“If there is water in such an unexpected place, it leaves possibility for the rest of the universe,” said Postberg.
